Frontier Pets - Competition to Win an Overnight Stay at Ovolo

Promotion Terms and Conditions

1.             The promoter of the Frontier Pets - Competition to Win $200 Pet Food & a VIPooch Accommodation Package at Ovolo Hotels (Promotion) is Frontier Pets Pty Ltd ABN 67 153 986 1173 Kingsford Smith Drive, Pinkenba QLD 4008 (Promoter).

2.             Information on how to enter and prizes forms part of these terms and conditions (Terms).  You acknowledge that by entering into the Competition to Win $200 Pet Food & a VIPooch Accommodation Package at Ovolo Hotels (Promotion) you have read and understood these Terms and that your entry is deemed to be an acceptance of these Terms.

1             Eligibility

1.1          The Promotion is open to all residents of Australia who are 18 years or older (Entrants)

1.2          Employees and immediate family members of the Promoter and of any related bodies corporate or any agencies associated with the Promoter, are not eligible to enter.

2             Promotion Period

3.             The Promotion commences on Tuesday 12^th November , 2024 at 9:00am AEDT to [ Sunday 8^th December, 2024 at 11:59pm AEDT (Promotion Period). Entries received outside the Promotion Period will not be valid.

3             How to enter the Promotion

4.             This is a game of chance and skill plays no part in determining the winner. Each entry will have an equal chance of winning.

3.1          To enter the Promotion, Entrants must:

(1)           Complete the survey form found on the Promoter’s website at https://frontierpets.com.au/pages/ovolo-giveaway and submit to enter into the Promotion. All details on the survey form must be filled out accurately, including a valid email address for the Entrant (Entry).

3.2          A valid email address is required to enter the Promotion.

3.3          Each Entrant may submit only one Entry into the Promotion

3.4          Any attempt to use automated or unfair methods to gain entries will result in disqualification (at the absolute discretion of the Promoter).

3.5          The Promoter is not responsible for any lost, late, or misdirected entries.

4             Prize Details

4.1          There is one prize (Prize) to be won.

4.2          The Prize is non-transferable, and no cash alternative is available.

5.             The Prize is valued at RRP$570-$830 (depending on night of stay, location and room availability) plus GST and includes:

1.             A $200 digital voucher for Frontier Pets pet food and treats of the Winner’s choosing, to be redeemed online at frontierpets.com.au. Valid for 12 months from date of issue.

2.             1 x overnight stay in a V.I.Pooch room 2 people and 1 x pet (1 x additional pet is permitted, maximum of 2 pets, T&Cs apply) at an Ovolo Hotel in Australia (Melbourne, Sydney or Brisbane). Room amenities provided as part of the VIPooch Package include pet food, mealtime mat & water bowls, dog bed and plush toy that the pet can take home with after their stay.

4.3          The Prize does not include flights and travel arrangements to and from the Ovolo of choice. The competition winner is required to make their own way to and from the Ovolo Hotel of their choice in either Brisbane, Sydney or Melbourne.

6.             The Prize must be redeemed within one year of the Promotion ending, which will be 8^th December 2025.

4.5          All Prizes are subject to availability. The Promoter reserves the right to substitute the Prize with an alternative of equal or greater value subject to compliance with applicable laws.

4.6          The Prize must be taken as described and no compensation will be payable if the winner is unable to use the Prize. Any costs incurred in connection with taking or using the Prize will be the sole responsibility of the winner.

4.7          The value of the Prize is accurate and based upon the recommended retail price(s) at the commencement of the Promotion Period. The Promoter accepts no responsibility for any variation in the value of the Prize after that date.

4.8          The Prizes are not transferable and cannot be taken, refunded, exchanged or transferred for cash. 

5             Winner Selection

5.1          The winner will be randomly selected from all valid entries received during the Promotion Period (Winner(s)).

7.             The draw to determine the Winner will take place on 9^th December at Frontier Pets Pty Ltd, 1173 Kingsford Smith Drive Pinkenba QLD 4008 at 10am AEDT.

8.             The Promoter may draw a second and third name at the time of the prize draw and record those names. If the first drawn Winner cannot be contacted or does not claim the prize in accordance with condition 6.3, the second drawn Winner will be contacted by the Promoter. If the second drawn Winner cannot be contacted, the third drawn Winner will be contacted by the Promoter. The second and third drawn Winner’s names will not be published or contacted unless the Winner fails to claim their prize during the 7-day period after notification of the draw by the Promoter. The second and third drawn Winners will not receive any prize unless the earlier drawn winning entrants are not able to be contacted.

5.2          The Promoter reserves the right to verify the validity of any and all Entries and Entrants and reserves the right to disqualify any Entrant for: (a) providing false or misleading registration information; (b) tampering with the entry process; or (c) engaging in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.

6             Winner notification and verification

6.1          The Winner will be:

1.             notified by [email using the email address provided in the winner’s Entry and by phone using the mobile number provided in the winner’s Entry within [7 days] of the end of the Promotion Period; and

(1)           published on the Promoter’s website at https://frontierpets.com.au/pages/ovolo-giveaway within 7 days of the Winner being notified for a minimum of 28 days.

6.2          The Winner must respond to the Promoter within 7 days of being notified of being a winner,  in order to claim the Prize.

6.3          The Winner may be required to provide proof of eligibility, identity, and residence.

6.4          Entrants are responsible for notifying Promoter of any change to their contact details during the Promotion Period.

7             Social Media

7.1          The Promotion is in no way affiliated, sponsored, or endorsed by Facebook and/or Instagram or any other social media platforms.

8             Privacy and consent

8.1          All Entries become the property of the Promoter.

8.2          By submitting an entry into the Promotion, the Entrant agrees:

(1)           to the Promoter’s privacy policy;

(2)           that their personal information will be used by the Promoter and the Promoter’s third party service providers and any applicable regulators, in connection with the administration of the Promotion and announcement of the Winners; and

(3)           to receive direct marketing materials about Frontier Pets and the Promotion. The Entrant’s personal details will be stored in accordance with the Promoter’s privacy policy.

8.3          The Promoter will not otherwise share an Entrant’s personal details with any third parties except in accordance with the Promoter’s privacy policy, these Terms and as required by law (including to authorities that regulate this Promotion and organisations that will need to allocate the prizes to the Winners).

9             Promoter Responsibility

9.1          Except for any liability that cannot be excluded by law (including under the Australian Consumer Law), the Promoter excludes all liability for any loss or damage whether direct, indirect, special or consequential arising in any way out of the Promotion, including, but not limited to any liability arising from or in connection with:

(1)           any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

(2)           any theft, unauthorised access or third party interference;

(3)           any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

(4)           any tax liability incurred by the winner or Entrant; and

(5)           use of, or condition of, the Prize including any personal injury or illness caused by the Prize.

 

9.2          If despite condition 11.1, the Promoter incurs a liability to an entrant under any law which implies a warranty into these Terms which cannot legally be excluded, the Promoter’s liability in respect of the Promotion is limited, in the Promoter’s discretion, to resupplying such goods or services which form part of the Promotion, or paying the costs of resupplying those goods or services.

9.3          These Terms do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010 (Cth)), where to do so would contravene that statute.

 

General Terms

9.4          Any decision of the Promoter is final and no correspondence will be entered into (subject to any applicable directions provided by a licensing authority in relation to any disputes about these Terms).

9.5          To the maximum extent permitted by law, the Promoter reserves the right to amend these Terms, or cancel the Promotion at any time without liability to any entrant or other person (subject to compliance with applicable regulations and any directions of a licensing authority).   

9.6          If for any reason this Promotion is not capable of running as planned (including where the Promotion is impacted by infection by computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures, changes to the availability of the Prize or any other cause beyond the control of the Promoter), the Promoter reserves the right in its sole discretion and subject to any written direction given by a relevant regulatory authority, to cancel, terminate, modify or suspend the Promotion and no compensation will be payable to any Entrants. 

9.7          The laws of the State of New South Wales, Australia shall govern these Terms. The parties submit to the non-exclusive jurisdiction of the New South Wales Courts and the Courts of the Commonwealth.
